Terms and Conditions

1. GENERAL PROVISIONS

1.1. The online store available at janmooremaison.com is operated by Jan Moore Maison Sp. z o.o., with its registered office in Łódź, Al. Tadeusza Kościuszki 80/82, unit 301, 90-437 Łódź, Poland,

1.2. These Terms and Conditions define the rules for using the Online Store, the sale of Products, and the provision of electronic services by the Seller.

1.3. The conditions for using the Store, including placing orders, payments, delivery, returns, and complaints, are set out in these Terms and Conditions.

2. DEFINITIONS

2.1. Business Day – any day from Monday to Friday, excluding public holidays.

2.2. Order Form – an interactive form available in the Store enabling the placement of an order.

2.3. Customer – a natural person, legal person, or organizational unit using the Store.

2.4. Consumer – a natural person making a purchase for purposes not directly related to business or professional activity.

2.5. Entrepreneur – a natural person, legal person, or organizational unit conducting business activity.

2.6. Product – goods offered in the Store that are the subject of the Sales Agreement.

2.7. Terms and Conditions – these Online Store Terms and Conditions.

2.8. Online Store – the store available at janmooremaison.com.

2.9. Seller – Jan Moore Maison Sp. z o.o.

2.10. Sales Agreement – a sales agreement for a Product concluded between the Customer and the Seller.

2.11. Electronic Service – a service provided electronically by the Seller.

2.12. Service User – a person using the services offered by the Store.

3. GENERAL CONDITIONS

3.1. Using the Store requires a device with Internet access and a web browser.

3.2. Product prices are given in Polish zloty (PLN), euros (EUR), US dollars (USD), British pounds (GBP), Swiss francs (CHF), and United Arab Emirates dirhams (AED).

Prices include VAT only where the obligation to charge VAT arises under European Union law.

For deliveries outside the European Union, prices do not include VAT, and any taxes, customs duties, or other import charges imposed by local authorities shall be borne by the Customer.

3.3. Information presented in the Store does not constitute an offer within the meaning of the Civil Code, but an invitation to conclude a contract.

4. ORDER PLACEMENT AND PROCESSING

4.1. To place an order, the Customer selects a Product, adds it to the cart, completes the Order Form, provides contact details, and selects a payment and delivery method.

4.2. The order becomes binding upon clicking the “Pay now” button and successful completion of payment.

4.3. The Store confirms acceptance of the order electronically.

4.4. In the case of cash-on-delivery orders: if the Customer refuses to accept the shipment or fails to collect it within the specified time, the Seller has the right to charge the Customer for shipping and return costs.

5. WITHDRAWAL FROM THE CONTRACT AND RETURNS

5.1. In accordance with the Consumer Rights Act and Directive 2011/83/EU of the European Parliament and of the Council, the Consumer has the right to withdraw from a distance contract within 14 days from the date of receiving the shipment, without giving any reason.

5.2. To exercise the right of withdrawal, the Customer must submit a clear statement to the Seller in electronic or written form.

5.3. In the event of withdrawal, the Seller shall refund an amount equal to the Product price, reduced by the actual cost of delivery to the Customer (also in the case of free delivery).

5.4. A return will be accepted only if:

  • the Product is new and shows no signs of use,
  • it has no stains, pilling, mechanical damage, or foreign odors,
  • all tags, labels, and security elements remain intact,
  • the Product has not been washed, ironed, or altered.

5.5. Brand set elements (e.g. decorative box, bag, dedicated hanger, protective cover) are an integral part of the Product and must be returned intact. Missing or damaged elements will result in a deduction of PLN 20 from the refund.

5.6. The Seller has the right to refuse the return if the conditions set out in section 5.4 are not met.

5.7. The Customer must return the Product within 14 days from submitting the withdrawal statement. Registered shipping with tracking is recommended.

5.8. Refunds are issued within 14 days from receipt and positive verification of the returned Product, using the same payment method used by the Customer, unless otherwise agreed.

5.9. If a refund cannot be made using the original payment method, the Seller will request bank account details via the return form or another method. Providing such details is necessary to process the refund.

6. COMPLAINTS

6.1. The Seller is liable for defects in the Products in accordance with applicable law.

6.2. Complaints may be submitted electronically via e-mail at: janmooreboutique@gmail.com.

6.3. If a complaint is accepted, the Seller shall refund the full amount paid for the Product, including delivery costs incurred at purchase.

6.4. In the event of a return under a complaint, return shipping costs shall be borne by the Seller.

7. DELIVERY AND SHIPPING COSTS

7.1. Delivery of Products is carried out via courier services.

7.2. Delivery is free of charge worldwide. Delivery costs are included in the Product price and may vary depending on the delivery country, currency, and applicable logistics conditions.

8. PERSONAL DATA

8.1. Customers’ personal data is processed in accordance with GDPR and the Privacy Policy available in the Store.

9. FINAL PROVISIONS

9.1. The Seller reserves the right to amend these Terms and Conditions. Changes take effect upon publication on the Store’s website.

9.2. Agreements are concluded in Polish and are governed by Polish law.

RETURN PROCEDURE

1. Right of Return:

  • The Customer has the right to withdraw from the sales agreement within 14 calendar days from the date of receiving the Product, without providing a reason.

2. Return Conditions:

  • The Product must be returned in an undamaged condition, in the same state as when shipped.
  • The Product must not show signs of use, and all tags must remain attached, intact, and not removed.
  • Return shipping costs are borne by the Customer unless the Store decides otherwise.

4. Refund:

  • After receipt and positive verification of the returned Product, the Store will refund the amount paid by the Customer, reduced by the actual cost of delivery to the Customer (also in the case of free delivery).
  • The refund will be made using the same payment method used for the original purchase, unless otherwise agreed.

5. Exceptions:

  • The right of withdrawal does not apply to:
    • Products made to order according to the Customer’s individual specifications or tailored to their personalized needs,
    • Products opened after delivery which, due to health protection or hygiene reasons, cannot be returned (e.g. underwear, cosmetics).
